Desmond J. Kidney


Des moved to Oregon shortly after graduating from law school to pursue work in intellectual property and appellate work. Much of his early work related to trademark prosecution and copyright licensing, as well as IP litigation—mostly patent, trademark, and trade secret misappropriation. Notable successes include a precedential opinion from the Court of Appeals for the Federal Circuit interpreting statutory definitions of “use in commerce” for trademarks. His freelance work drafting appeals broadened his legal base beyond IP, and at Kivel & Howard he also focuses on trusts and estate planning work.


Des reads extensively and writes novel-length fiction.  When he can gather the people for it, he also enjoys board games of most sorts.  He also enjoys ballroom and country dancing.
