Fatal Pedestrian Accidents in Oregon
In Oregon, if a pedestrian is killed in an accident caused by someone else’s negligence, the victim’s family may be able to recover certain types of damages through a wrongful death claim. These can include lost earnings, loss of companionship, funeral costs, and burial expenses.
To recover these types of damages, the victim’s family must first prove that the death was caused by another party’s negligence. This can be done by showing that the party owed the victim a duty of care and breached that duty, which directly led to the victim’s death. For example, if a driver failed to yield to a pedestrian in a crosswalk and struck and killed them, the driver would likely be found negligent.
Once negligence has been established, the victim’s family can then begin to recover financial compensation for the damages they face. Lost earnings are perhaps the most common type of damage sought in these cases. This is because when a loved one dies unexpectedly, their income is often suddenly cut off. This can leave families struggling to make ends meet.
Loss of companionship damages are also available in Oregon. These are intended to compensate for the loss of love and support that comes with losing a family member. Funeral costs and burial expenses are also typically recoverable in these cases.
If you have lost a loved one in a pedestrian accident caused by someone else’s negligence, you may be entitled to recover financial compensation for your damages through a wrongful death claim. It is important that you reach out to a wrongful death lawyer in Independence right away.
